1. Acceptance of Terms

By accessing or using the Creative Spaces LLC website or by booking and utilizing our studio facilities, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with any part of these Terms, you must not use our Services.

2. Booking Procedures and Studio Access

2.1 Booking: All studio bookings are subject to availability and must be made through our official booking portal or by contacting us directly. A booking is confirmed only upon receipt of a deposit and written confirmation from Creative Spaces LLC.

2.2 Rental Periods: Our studio is available for rent in hourly, half-day (4 hours), and full-day (8 hours) blocks. Extended rental periods can be arranged upon request and may be subject to different pricing structures.

2.3 Studio Access: Upon confirmation of your booking, you will be provided with access details and any necessary instructions for entering and using the studio. Any unauthorized access or use of the studio is strictly prohibited.

2.4 Overtime: If your rental period exceeds the agreed-upon time, you will be charged for overtime at the standard hourly rate, which may be higher than the initial booking rate. Please communicate any anticipated overages to our staff.

3. Payment Terms

3.1 Deposit: A non-refundable deposit of 50% of the total rental fee is required at the time of booking to secure your reservation.

3.2 Final Payment: The remaining balance is due in full at least 48 hours prior to the commencement of your rental period. Failure to make timely payment may result in the cancellation of your booking.

3.3 Additional Charges: Any additional charges incurred for overtime, damages, excessive cleaning, or use of optional equipment not included in the base rental fee will be billed separately and are due upon receipt.

3.4 Payment Methods: We accept major credit cards, bank transfers, and certified checks. Please inquire about specific payment options.

4. Cancellation and Rescheduling Policy

We understand that plans can change. Our cancellation policy is designed to be fair to both our clients and our business operations:

• Cancellations made more than 7 days prior to the booking date: You will receive a full refund of any amount paid beyond the non-refundable deposit.
• Cancellations made between 3 and 7 days prior to the booking date: 50% of the total rental fee is forfeited. The remaining balance may be credited towards a future booking, valid for 90 days.
• Cancellations made less than 3 days prior to the booking date: The full rental fee is forfeited. No refunds or credits will be issued.

Rescheduling: Requests to reschedule a booking must be made at least 72 hours in advance. Rescheduling is subject to availability and may incur a rescheduling fee of 10% of the rental cost. Repeated rescheduling may be treated as a cancellation.

5. Studio Usage Rules and Responsibilities

Clients and their guests are responsible for adhering to the following rules:

• No Smoking: The studio is a strictly non-smoking facility.
• No Illegal Activities: Any illegal activities on the premises will result in immediate termination of the rental and notification to authorities.
• Respect Property: Treat the studio and all equipment with care. Any damage or loss of property must be reported immediately and will be charged to the client.
• Noise Levels: Maintain reasonable noise levels to avoid disturbing neighboring businesses and residents.
• Food and Drink: Consume food and beverages only in designated areas to prevent spills and stains.
• Set Construction: Any modifications, painting, or drilling into walls, floors, or ceilings are strictly prohibited without prior written consent.
• Fire Safety: Adhere to all fire safety regulations. Do not block emergency exits or equipment.
• Cleaning: The studio should be returned in a clean and tidy condition. Excessive cleaning required due to negligence will incur additional charges.
• Guest Policy: The number of persons present in the studio during the rental period must not exceed the agreed-upon capacity unless prior arrangements have been made.

6. Equipment Rental and Usage

6.1 Equipment Provided: A list of standard equipment included in the studio rental is available on our website. Clients are encouraged to familiarize themselves with this list.

6.2 Additional Equipment: We offer a range of additional lighting, grip, and camera equipment for rent. Please check our equipment list for availability and pricing. All additional equipment rentals are subject to availability and may require advance booking.

6.3 Equipment Condition: All equipment is provided in good working order. Clients are expected to inspect equipment prior to use and report any issues immediately. Creative Spaces LLC is not liable for equipment malfunctions beyond its control.

6.4 Client-Provided Equipment: If clients bring their own equipment, they are solely responsible for its operation, safety, and any damages it may cause.

7. Liability and Insurance

7.1 Limitation of Liability: Creative Spaces LLC, its owners, employees, and affiliates shall not be held liable for any loss, damage, injury, or death sustained by the client, their guests, or their property while on the studio premises, unless such loss, damage, injury, or death is directly caused by the gross negligence or willful misconduct of Creative Spaces LLC.

7.2 Indemnification: The client agrees to indemnify and hold harmless Creative Spaces LLC from any and all claims, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising out of or related to the client's use of the studio and Services, including but not limited to any damage to the studio or its contents caused by the client or their guests.

7.3 Insurance: Clients are strongly advised to obtain their own liability and property insurance coverage for the duration of their rental period. Creative Spaces LLC does not provide insurance coverage for clients or their belongings.

8. Intellectual Property and Content

Creative Spaces LLC does not claim ownership over any content created or captured by clients within our studios. However, clients acknowledge that any images or videos captured within the studio may be subject to copyright laws and intellectual property rights of third parties (e.g., models, artists). Clients are responsible for obtaining all necessary permissions and releases for the use of any intellectual property within their productions.

Creative Spaces LLC reserves the right to use images or videos captured in the studio for marketing and promotional purposes, provided that such use does not infringe upon the privacy or intellectual property rights of the client or their subjects. Clients may opt-out of this promotional use by providing written notice.

9. Dispute Resolution

Any disputes arising from or in connection with these Terms or the use of our Services shall be attempted to be resolved amicably through good-faith negotiation. If an amicable resolution cannot be reached, the dispute shall be submitted to mediation in Metropolis. If mediation is unsuccessful, the dispute shall be settled by arbitration in accordance with the rules of the Metropolis Chamber of Commerce, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

These Terms shall be governed by and construed in accordance with the laws of the State of Metropolis, without regard to its conflict of law principles.

10. General Provisions

10.1 Amendments: Creative Spaces LLC reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Continued use of our Services after any such changes constitutes your acceptance of the new Terms.

10.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10.3 Waivers: No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

10.4 Force Majeure: Creative Spaces LLC shall not be liable for any failure or delay in performance under these Terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
